Terms of Service

These Terms of Service (the "Terms") govern your use of the websites, hosting, cloud, network, and design services provided by Poxif ("Poxif", "we", "us", or "our"). By accessing or using any of our services, you agree to be bound by these Terms.

01Acceptance of Terms

By creating an account, placing an order, or otherwise using the services we provide, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you must not use our services.

02Services

Poxif provides a range of digital services, including but not limited to:

• Web hosting and managed hosting
• Cloud infrastructure design and operations
• Network architecture and security design
• Web design, web development, and digital strategy
• Ongoing support, monitoring, and maintenance

The specific scope, deliverables, and timelines for each engagement will be set out in a written quote, statement of work, or order confirmation, which forms part of these Terms.

03Accounts & Eligibility

You must be at least 18 years old and capable of entering into a binding contract under the laws of your jurisdiction. You are responsible for keeping your account credentials confidential and for any activity that occurs under your account.

You agree to provide accurate and current information at sign-up and to keep that information up to date.

04Acceptable Use

You may not use Poxif services to:

• Host or distribute unlawful, defamatory, or infringing content
• Send unsolicited bulk email (spam) or engage in phishing
• Distribute malware, viruses, or other harmful code
• Run cryptocurrency mining or similarly resource-abusive workloads on shared infrastructure
• Conduct denial-of-service attacks or unauthorised security testing
• Violate the privacy or intellectual property rights of any third party

We reserve the right to investigate suspected violations and to suspend or terminate services where necessary to protect our network, our customers, or third parties.

05Fees & Billing

Fees for hosting, cloud, and recurring services are billed in advance on a monthly or annual cycle, as set out in your order. Project-based work (such as design and development engagements) is billed according to the agreed milestone schedule.

All fees are stated in Australian Dollars (AUD) and are exclusive of GST unless otherwise stated. Late payments may incur interest at a rate of 1.5% per month or the maximum permitted by law, whichever is lower.

Recurring services renew automatically unless cancelled before the next billing cycle. Setup fees and project deposits are non-refundable except where required by law.

06Service Level & Uptime

We target 99.99% availability for our managed hosting and cloud services, measured monthly and excluding scheduled maintenance windows. Specific service-level commitments, where offered, are documented in the applicable Service Level Agreement.

We may perform scheduled maintenance with reasonable advance notice. Emergency maintenance may be carried out without notice where necessary to protect the security or integrity of the service.

07Data, Backups & Security

You retain ownership of all data you upload, store, or process through our services ("Customer Data"). You grant Poxif a limited licence to host, transmit, and process Customer Data only as needed to provide the services.

We perform routine backups of managed hosting environments, however you remain responsible for maintaining your own backups of any data you consider critical. Poxif is not liable for data loss except where caused by our gross negligence or wilful misconduct.

We implement industry-standard security controls — including encryption in transit, network isolation, and access logging — but no system is completely secure. You are responsible for following secure-development practices in any code you deploy on our infrastructure.

08Suspension & Termination

We may suspend or terminate your services if you breach these Terms, fail to pay outstanding fees, or use the service in a way that endangers our network or other customers. Where reasonably practicable, we will notify you and give you an opportunity to cure the breach.

Either party may terminate a recurring service at the end of the current billing cycle by giving written notice. Upon termination, you remain liable for any fees accrued up to the termination date.

09Intellectual Property

All Poxif software, designs, documentation, branding, and other materials remain the intellectual property of Poxif or its licensors. Custom deliverables produced for you under a statement of work transfer to you upon final payment, except for any pre-existing tools, libraries, or frameworks owned by Poxif, which you receive a perpetual licence to use as part of your deliverable.

10Limitation of Liability

To the maximum extent permitted by law, Poxif's total aggregate liability arising out of or in connection with these Terms is limited to the fees paid by you to Poxif for the affected service in the three (3) months immediately preceding the event giving rise to the claim.

In no event shall Poxif be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities.

Nothing in these Terms excludes liability that cannot be excluded under the Australian Consumer Law or other applicable law.

11Privacy

Our handling of personal information is described in our Privacy Policy. By using our services, you consent to the collection and use of your information as described in that policy.

12Changes to Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent version. Material changes will be notified by email or through your client area. Continued use of the services after changes take effect constitutes acceptance of the updated Terms.

13Governing Law

These Terms are governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of New South Wales for any disputes arising under these Terms.
